“Is the attorney a resolution-based person, or litigation-based? Do they want to fight about every thing, or is the attorney really looking to help resolve the issues?” asks Beck. “It’s important to take the time to work through issues and really make agreements and decisions based on what’s in everyone’s best interests.”

Beck says that she’s more inclined to reserve court as the last resort. She also stresses the importance of using mediation in her Covington family law practice.  “I typically use mediators that are certified with the Administrative Office of the Courts, the office that oversees the court in Kentucky. Those are attorneys that have been through specific training to mediate family law cases,” Beck explains.

Because family courts in Kentucky are so overburdened with backlog of cases, Beck says it’s becoming more and more common for courts to order parties to go to mediation. When clients can’t afford the added expense of using a mediator, Beck says she will organize settlement conferences between the parties and attorneys to try to mediate a case

Beck’s advice about choosing the right family law attorney? “Find out if the attorney is more likely to just fight things out in court, which isn’t going to help the situation in the long-term, or if they’re willing to through the process and use mediation to come to a resolution.”
